520 |a European Union adopted the Directive 2010/64/EU on the right to interpretation and translation in criminal proceedings in attempts to ensure mutual trust between parties. The Directive was implemented in Slovenian legislature in the Criminal Procedure Act, which in essence meets all the main requirements under the directive. The Directive gives the persons who are suspected or accused of having committed a criminal offence the right to interpretation and translation. In this way they are allowed and enabled to follow and actively participate in judicial proceedings in accordance with existing international standards and case-law. However, the goal of mutual trust between the Member States is not easily achieved. Problems may arise in practice due to the loose wording of the Directive or the national legislationʼs failure to provide for all the necessary mechanisms required under the Directive. The article presents the relevant legal framework and analyses the possible problems suspected or accused persons might have when trying to enforce their rights.
